Campsite Booking Terms & Conditions

These Terms and Conditions apply to bookings at the campsite owned by Mark Adcock T/A Ngepi Camp (“Owner”). The Terms and Conditions form the basis of your contract with the Owner so please read them carefully before making a reservation.

1.Definitions:

Booking and Payment of Booking Deposit

1. A booking is made by completing and submitting the Booking and paying the Booking Deposit.
2. The Customer must pay the Booking Deposit to the Owner within 14 (Fourteen) days of submitting the Booking.
3. Once the Owner has received the Booking and the Booking Deposit the Owner will send the Customer a Booking Confirmation.  At this point a binding contract exists.

Payment of Fees

1. The Customer must pay the balance of the Fees due to the Owner on or before the Start Date.

Cancellation of Booking

1. If the Customer cancels the booking more than 60 (Sixty) days before the Start Date the Deposit and all other sums (if any) paid by the Customer will be refunded.
2. If the Customer cancels the booking by giving less than 60 (Sixty) days’ notice the Owner shall be entitled to retain the Deposit but will refund all other sums (if any) paid by the Customer.
3. If the Customer has not arrived at the Site by 10pm on the Start Date and has not been in contact with the Owner to explain the delay the Customer will be deemed to have cancelled the booking and the Owner shall be entitled to retain the Booking Deposit but will refund all other sums (if any) paid by the Customer.

Owner’s obligations during the Licence Period

1. The Customer may use the paths and drives leading to the Pitch to go to and from it.
2. The Customer may use such parts of the Site as the Owner has designated for shared use.

Customer’s obligations during the Licence Period

1. The Customer agrees with the Owner:
2. To pitch as directed by Site staff and ensure that tents and other items (excluding guy ropes) are at least 6 meters apart from other tents.
3. To use the Pitch in a reasonable and careful manner and to keep the Pitch clean and tidy at all times.
4. To use the Site facilities in a reasonable and careful manner.
5. To place all refuse in the receptacle(s) provided for the Pitch by the Owner.
6. That any tents or other items placed on the Pitch will not exceed the number allowed for in the breakdown of the Pitch Fee.
7. That the Pitch will be occupied by no more than the number of people allowed for in the breakdown of the Pitch Fee.
8. That children will be properly supervised at all times on the Site.
9. That any vehicle brought onto the Site shall be roadworthy and have a valid tax disc and shall be driven only by a driver holding a full current driving licence.
10. Not to drive any vehicle on the Site after 11pm or before 5am unless previously arranged with management.
11. Not to do anything which may be a nuisance to or cause damage or annoyance to the Owner or other occupiers of the Site.
12. Not to play any musical instrument or other audio device after 11pm or before 8am and to keep noise to a minimum between those hours.
13. Not to use the Pitch for any illegal or immoral purposes.
14. Not to cause or permit any dangerous or inflammable substance to collect in or on the Pitch apart from those designed for use with outdoor cooking equipment.
15. Not to bring any animal or pet to the Site.
16. Not to smoke on the Site except in designated smoking areas.
17. To park vehicles only where the Owner may designate.
18. Not to leave any belongings place any items or hang any washing in the communal areas of the Site except in areas designated for that particular purpose.
19. To comply with any regulations which the owner of the Site or its agents may from time to time make in the interests of good management of the Site.
20. At the end of the Licence Period to remove the Customer’s belongings from the Pitch and leave the Pitch clean and tidy so that the Pitch is ready for immediate re-occupation.

Termination

1. If there has been a substantial breach of any of the Customer’s obligations or if the behaviour of or level of noise generated by the Customer and his guests is unacceptable to the Owner the Owner may with immediate effect terminate the Customer’s licence to use the Pitch and the Pitch must be vacated and no refund will be given.

General

1. Any obligation on the Customer in these Terms and Conditions not to do an act or thing includes an obligation not to permit or suffer another person to do such act or thing.
2. To the fullest extent permissible by law ALL persons, including but not limited to the Customer or guests / visitors / family of the Customer,  entering these premises and using its facilities, including the parking areas do so entirely at their own risk. The owners, employees, agents, representatives and management of the Owner shall not be liable for any damage, loss, theft, injury, accident or death by any person, howsoever caused.
3. To the fullest extent permissible by law ALL persons, including but not limited to the Customer or guests / visitors / family of the Customer,  partaking in any activities offered by or booked by the Owner or any Ngepi staff, do so entirely at their own risk. The owners, employees, agents, representatives and management of the Owner shall not be liable for any damage, loss, theft, injury, accident or death by any person, howsoever caused.
4. Whenever there is more than one person comprising the Owner or the Customer their obligations may be enforced against all of them jointly and against each of them individually.
5. An obligation in these Terms and Conditions to pay money includes an obligation to pay Value Added Tax in respect of that payment.
6. This contract between the Owner and the Customer shall be governed by the law of the Republic of Namibia.
